Industrial Models and Designs (DMI)
An industrial model or design constitutes the ornamental or aesthetic aspect of an article, in other words, the visual appearance of an article which can be a product or part of a product that can be manufactured and sold independently. An industrial model or design may consist of three-dimensional features, such as the shape of an article, or two-dimensional features, such as patterns, lines or color. A industrial model or design is an industrial property right that is registered with a national, regional or international office. In Morocco, an industrial model or design is filed with the OMPIC (Moroccan Office for Industrial and Commercial Property), or through WIPO (World Intellectual Property Organization) by filing an international DMI designating Morocco (Hague System). The owner of a registered industrial model or design is provided with the exclusive exploitation rights. It also allows the owner to prevent counterfeiters from reproducing or imitating (substantial copying) of the protected design.
Registration system
Registration system
Once a design/industrial model application is filed, it will be examined as to the form (if all the required documents are submitted) and to verify if the subject matter of the application correspond to the definition of a design/industrial model. The PTO will issue immediately a filing receipt followed by the certificate of registration within one month. The design/industrial model will then be published in the official gazette.
One design/industrial model application can contain up to 100 designs per application provided that these designs belong to the same class as per Locarno International Classification.
It is possible to file different views with each design and there is no limitation for number of views.
No examination regarding novelty is conducted by the TMO.
The publication can be postponed for a maximum period of 18 months at the request of the applicant at the time of filing. The applicant can at any time, within this period, request the immediate publication.
The industrial model or design is registered for a validity period of 5 years starting from filing date. Such period is renewable for 4 other consecutive periods of 5 years each (the maximum period of protection is 25 years as from filing date).
